By accessing or using BrightStar Events ("BrightStar," "we," "us," or "our"), including our website at brightstarevents.com and any associated services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
If you are using BrightStar on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
If you do not agree to these Terms, you may not access or use our services.
2. Description of Services
BrightStar is an event ticketing and management platform designed specifically for the conscious events community, including but not limited to:
Yoga classes, workshops, and teacher trainings
Meditation retreats and mindfulness programs
Kirtan, sacred music concerts, and sound healing events
Wellness festivals and spiritual gatherings
Breathwork sessions and holistic health events
Personal development workshops and seminars
Our platform enables event organizers ("Organizers") to create, manage, and sell tickets to events, and allows attendees ("Attendees") to discover and purchase tickets to these events.
3. User Accounts
Account Creation
To access certain features of BrightStar, you must create an account. When creating an account, you agree to:
Provide accurate, current, and complete information
Maintain and promptly update your account information
Maintain the security and confidentiality of your login credentials
Accept responsibility for all activities under your account
Notify us immediately of any unauthorized use of your account
Age Requirements
You must be at least 18 years old to create an account and use our services. If you are under 18, you may only use BrightStar with the involvement and consent of a parent or legal guardian.
Account Termination
We reserve the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or any conduct that we determine is harmful to other users or our platform.
4. Ticket Purchases
Purchasing Tickets
When you purchase a ticket through BrightStar, you are entering into a transaction with the event Organizer. BrightStar acts as an intermediary platform facilitating this transaction.
Pricing and Fees
All ticket prices are set by the event Organizer. BrightStar may charge service fees, which will be clearly displayed before you complete your purchase. All fees are non-refundable unless otherwise stated.
Payment Processing
Payments are processed through our secure third-party payment processors. By making a purchase, you authorize us to charge your selected payment method for the total amount of your order, including any applicable taxes and fees.
Ticket Delivery
Tickets are delivered electronically to the email address associated with your account. You are responsible for ensuring your email address is correct and for checking your spam folder if you do not receive your tickets.
Important: Your ticket is your proof of purchase. Keep it safe and do not share your ticket barcode or QR code with others unless transferring your ticket.
5. Event Organizer Terms
Organizer Responsibilities
If you use BrightStar as an event Organizer, you agree to:
Provide accurate and complete event information
Honor all tickets sold through our platform
Comply with all applicable laws and regulations
Maintain appropriate insurance for your events
Handle attendee data in accordance with privacy laws
Communicate event changes or cancellations promptly
Process refunds in accordance with your stated refund policy
Organizer Fees
Organizers agree to BrightStar's fee structure as outlined in our pricing documentation. Fees are deducted from ticket sales before payout, unless otherwise arranged.
Payouts
Organizers will receive payouts according to our standard payout schedule. BrightStar reserves the right to withhold payouts in cases of suspected fraud, chargebacks, or Terms violations.
Event Content
Organizers are solely responsible for their event content, including descriptions, images, and any materials presented at their events. Content must not violate any laws, infringe on intellectual property rights, or contain harmful or misleading information.
6. Refunds and Cancellations
Organizer Refund Policies
Each event Organizer sets their own refund policy, which is displayed on the event page. By purchasing a ticket, you agree to the Organizer's stated refund policy.
Event Cancellations
If an event is cancelled by the Organizer, attendees are entitled to a full refund of the ticket price. BrightStar service fees may or may not be refunded depending on the circumstances of the cancellation.
Event Postponements
If an event is postponed to a new date, your ticket will typically be valid for the new date. If you cannot attend the new date, refund availability is subject to the Organizer's policy.
Requesting Refunds
Refund requests should be directed to the event Organizer. BrightStar can assist in facilitating communication but is not responsible for Organizer refund decisions outside of cancellations.
Please Note: BrightStar is not responsible for event quality, Organizer conduct, or any issues that arise at events. Our role is limited to providing the ticketing platform.
7. User Conduct
When using BrightStar, you agree not to:
Violate any applicable laws or regulations
Infringe on the rights of others
Post false, misleading, or fraudulent content
Attempt to gain unauthorized access to our systems
Use automated systems to access our platform without permission
Interfere with the proper functioning of our services
Engage in ticket scalping or unauthorized resale
Harass, abuse, or harm other users
Use our platform for any illegal purposes
Impersonate another person or entity
8. Content and Intellectual Property
BrightStar Content
The BrightStar platform, including its design, features, code, and content, is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.
User Content
You retain ownership of content you submit to BrightStar. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content in connection with our services.
Copyright Complaints
If you believe content on BrightStar infringes your copyright, please contact us with the details. We will respond to valid copyright complaints in accordance with applicable law.
9. Limitation of Liability
Platform Provided "As Is"
BrightStar is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Damages
To the maximum extent permitted by law, BrightStar shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of our services.
Maximum Liability
Our total liability to you for any claims arising from these Terms or your use of BrightStar shall not exceed the amount you paid to BrightStar in the twelve (12) months preceding the claim.
Event Disclaimer
BrightStar is not responsible for the quality, safety, or legality of events listed on our platform. We do not endorse any Organizer or event and are not liable for any injury, loss, or damage that occurs at or in connection with any event.
10. Dispute Resolution
Informal Resolution
Before filing a formal dispute, you agree to contact us and attempt to resolve any dispute informally. We will try to resolve disputes through good-faith negotiations.
Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
Arbitration
Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration shall take place in Los Angeles County, California.
Class Action Waiver
You agree to resolve disputes with BrightStar on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration.
11. Changes to Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email or through a notice on our platform. Your continued use of BrightStar after changes become effective constitutes acceptance of the new Terms.
